Audley Travel Companion App Terms and Conditions

By downloading or using the Audley Travel Companion mobile or tablet application (“the Service”) these terms will automatically apply to you – you should make sure that you read them carefully before using the Service.

Terms of Use

When you travel with us, we want you to have the experience you’ve been imagining. To assist with this, our complimentary Audley Travel Companion application provides easy access to your Audley Travel itinerary so you can see exactly what you are doing each day of your trip, take photos and add notes, look up our restaurant recommendations and other ideas of things to do during your trip.

Audley Travel is offering you this application to use for your own personal use without cost. The application and all the trade marks, copyright, database rights and other intellectual property rights related to it still belong to Audley Travel. You should remember that the purpose of the application is to make things more convenient for you – it doesn’t replace your travel documents, and you will still need to bring them to the airport in order to fly.

We rely on third parties to provide information to us so that we can make it available to you. The information is not intended to wholly replace the need to stay informed of updates that are made on screens throughout the terminal or via airport loudspeaker announcements. We accept no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the application rather than using all the resources in the airport to keep yourself updated as to the details of your flight.

Internet/Wi-Fi

Certain functions of the application will require an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Audley Travel cannot take responsibility for the application not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the application outside of an area with Wi-Fi, you should remember that your terms of agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the mobile application, or other third party charges. In using the application, you’re accepting responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the application, please be aware that Audley Travel assumes that you have received permission from the bill payer for using the application.

Updates

At some point Audley Travel may wish to update the application. The application is currently available on Android and iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the application to) may change, and you’ll need to download the updates if you want to keep using the application.

Audley Travel does not promise that it will always update the application so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the application and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination the rights granted to you in these terms will end and you must stop using the application, and (if needed) delete it from your device.

Disclaimer regarding accuracy of content

Audley Travel will take all reasonable measures to prevent incorrect or incomplete information from appearing on the application, but does not guarantee or warrant (either explicitly or implicitly) the accuracy or completeness of the information.

It is your responsibility to keep advice and advisories up to date. You rely on the content at your own risk, the decision to travel is your sole responsibility and it is up to you to decide what constitutes ‘non-essential travel’, based on family or business requirements, knowledge of a country or region, and other factors. Audley Travel is not responsible for any financial consequences which result from you cancelling a scheduled trip based on information provided in the application.

This application is provided “as is” without any warranty or implied term of any kind, either express or implied, including but not limited to any implied warranties or implied terms of merchantability, fitness for a particular purpose or non-infringement. All such implied terms and warranties are hereby excluded.

Audley travel does not guarantee or warrant that the application or the server supporting this application is free of viruses or other harmful programmes. Use of this application is at your own risk. In no event will Audley Travel be liable for any direct, indirect or consequential loss (including without limitation those resulting from loss of profits, loss of business or goodwill, loss of or damage to data) arising from the use of the information and material contained in this application or any website linked to this.

You agree to indemnify Audley Travel in respect of any and all claims and liabilities (including legal fees) which may arise from your submissions, from your unauthorised use of material obtained through the Service, or from your breach of these terms and conditions.

All rights reserved. These materials (including without limitation all articles, text, images, design and logos etc.) but excluding the content you have added are copyright © Audley Travel Group Ltd.

If you wish to use our application content other than for personal, non-commercial home use you must contact Audley Travel for permission prior to use. Links to any of the content on our application are welcomed as long as it is clear that you are linking to our application and not passing off our content as yours. You must not imply that our application is affiliated with, or endorses another website or application in any way.

You are strictly prohibited from copying large sections of our content on the application. However, attributed links to our application, quoting no more than a single paragraph of text from a single page are allowed, providing the source is clearly obvious (for example with a link to audleytravel.com). If you would like to use multiple extracts of text from multiple pages, or a larger section of content from a single page, you must contact us to obtain permission first.

Intellectual Property

The application and its content (including without limitation the design, text, graphics and all software and source codes) are protected by copyright, trademarks, patents and other intellectual property rights and laws. In accessing the application you agree that you will access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of Audley Travel. This excludes the downloading, copying and/or printing of pages for personal, non-commercial home use only.

Third-Party Links, Sites, and Services

The application may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Audley Travel. Audley Travel does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from the application, you do so at your own risk and you agree that we will have no liability arising from your use of or access to any third-party website, service, or content.

Any claim relating to this application shall be governed by the laws of England and Wales.
